Terms of Service

General terms and conditions for products and services sold through the TachoMI.hu online store operated by TachoMI.hu Kft.

Important

By using the TachoData application, you accept the following general terms and conditions.

Service Provider: TachoMI.hu Korlátolt Felelősségű Társaság (1196 Budapest, Fő utca 53., Hungary; company registration number: 01-09-423043; tax number: 32417539-2-43; represented by: Gyula Styaszni, Managing Director)

Client: a natural person or business entity ordering products or services through the online store.

I. Subject of the contract

  1. Delivery of products purchased through the TachoMI.hu online store operated by the Service Provider.
  2. TachoMI.hu services ordered and paid for through the TachoMI.hu online store operated by the Service Provider.

II. Purchased products

The Service Provider shall ship the purchased and paid-for product free of charge within the European Union, and to other locations at the indicated shipping cost, subject to stock availability, within 2 working days of the purchase. The Client will be notified of the shipment by email.

III. Warranty

  1. The Service Provider provides a 1-year partial replacement warranty on purchased products at its own premises.
  2. The warranty is conditional upon the defective product being posted to TachoMI.hu Kft. at 1097 Budapest, Kén utca 6., Hungary.
  3. The Service Provider shall examine the product within 10 working days.
  4. If the product is found to be non-defective, the Service Provider shall return it to the Client at the Client's expense.
  5. Damaged products are excluded from the warranty scope. In such cases, the replacement or repair is carried out based on a mutually agreed offer with the Client.
  6. The repaired or replaced defective product is shipped by the Service Provider to the address specified by the Client.

IV. Service Provider's obligations

  1. The Service Provider operates a continuously available, 24/7 server centre.
  2. The ordered services are accessible through the operating server centre.
  3. The Service Provider provides the ordered services to the Client through its website and the associated application, which operate 24 hours a day.
  4. In the processing of driver and tachograph data, the Service Provider handles all requirements under EU Regulation 561/2006, Directive 2002/15/EC, and Act I of 1988, Sections 18/A-L, and undertakes to update them in the event of legislative changes, by the time the legislation enters into force.
  5. The Service Provider stores the data uploaded by the Client for three years from the date of receipt at the server centre, during the term of the contract.
  6. The Service Provider deletes the uploaded data 1 month after the termination of the contract.

V. Duration of the contract

The contract for the Services is for an indefinite term.

VI. Subscription periods

The service period is extended once a month by a recurring payment at the expiry of the service period. The Service Provider shall notify the Client of the extension of the service period by email.

VII. Payment terms

  1. Payment is made by bank card through the Barion Payment Zrt., SimplePay (OTP Mobil Kft.), or PayPal system, at the Client's choice.
  2. The monthly service fee is paid during the term of the contract by recurring charges to the bank card provided by the Client.
  3. The Client consents to recurring charges to their bank card up to the amount of the monthly fee for the services they have ordered.
  4. The invoice for purchased products or ordered services is sent by the Service Provider to the Client by email in PDF format.

VIII. Right of withdrawal

  1. In the case of a delivered product, the Client may withdraw from the purchase within 14 days of receipt of the product.
  2. The right of withdrawal only applies if the product is in undamaged, flawless condition and in its original packaging.
  3. In the case of withdrawal, the Client shall post the product at their own expense, in its original packaging, together with a withdrawal declaration and the printed original invoice, to TachoMI.hu Kft. (1097 Budapest, Kén utca 6., Hungary).
  4. The Client's withdrawal declaration must include the Client's name, bank name, address, IBAN account number, and SWIFT code.
  5. The Service Provider shall transfer the purchase price to the bank account specified by the Client within 14 working days of receipt of the product.
  6. For TachoMI.hu services, the Service Provider provides a one-time free trial before ordering.
  7. The Client is entitled to the right of withdrawal within 14 days of the order, in the case of a service not yet used.
  8. Once a service has been used after ordering, withdrawal is no longer possible.
  9. The withdrawal declaration for the service, together with the issued invoice in PDF format, must be sent by the Client to the email address rightofwithdrawal@TachoMI.hu.eu.
  10. The Service Provider shall transfer the purchase price to the bank account specified by the Client within 14 working days of receipt of the email containing the withdrawal declaration.
  11. If the Client is no longer entitled to the right of withdrawal, the Client may terminate the contract at any time in accordance with Section X.1.

IX. Service Provider information

  1. The Client acknowledges that the Service Provider is able to fully perform the ordered services only when the following conditions are simultaneously met:
    • the uninterrupted operation of both the Client's and the Service Provider's internet network, and
    • the operability of the Client's hardware devices (card reader, connecting computer).
  2. The Client consents to the processing of their personal data under this contract. The Service Provider declares that it maintains the Client's personal data in accordance with Act CXII of 2011 on the Right of Informational Self-Determination and Freedom of Information. The Service Provider uses the Client's personal data exclusively for the purposes set out in this contract.
  3. The Client acknowledges that the Service Provider is the owner of the copyright of the TachoMI.hu software. The Client is entitled to use the services of the TachoMI.hu software under this contract, and acquires only a limited user right to the TachoMI.hu software user interface, for the duration of this contract.
  4. The Service Provider provides the automatic option of downloading both the uploaded and processed data to the Client's own computer, within the committed data retention period, for the duration of the contract's validity.

X. Breach of contract

The Service Provider is not entitled to a fee for the duration of service outages caused by reasons attributable to it. The Client is entitled to a refund or credit for the next period from the prepaid fees, if the cost of the missed services reaches the net amount of HUF 200/month/driver.

XI. Termination of the contract

  1. The Client is entitled to ordinary termination of the contract through the online store at the end of the already paid period, at any time without justification.
  2. The Service Provider is entitled to immediate termination, effective at the end of the paid period, if the collection of the due monthly fee through the bank card provider's system is declined. In this case, the Service Provider shall notify the Client of the termination of the contract by email.
  3. Upon termination of the contract, the Client revokes the consent given for recurring charges to their bank card.

XII. Final provisions

  1. An inseparable part of this contract is the Privacy Policy (GDPR) of TachoMI.hu Kft.
  2. The contract becomes effective on the date of successful bank card payment of the Service fee through the Barion Payment Zrt. system.
  3. Matters not regulated in this contract shall be governed by the relevant provisions of the Hungarian Civil Code.
