Infringement Report

The Infringement report analyses and lists infringements under EU Regulation 561/2006, the AETR Agreement, the TCA (Transport Community Agreement), Directive 2002/15/EC and EU Regulation 165/2014 in a PDF report.

Driving time infringements

EU Regulation 561/2006, Articles 6–7

Infringement Limit
Daily driving time exceeded 9 hours (max. 10 hours, permitted twice per week)
Weekly driving time exceeded 56 hours
Bi-weekly driving time exceeded 90 hours (two consecutive weeks)
Continuous driving without break 4.5 hours (followed by min. 45-minute break)

Tachograph and driver card infringements

  • Missing country code entry
  • Missing country code at border crossing
  • Missing manual entry for period without card
  • Incorrect use of ferry/train symbol
  • Missing data on record sheet (name, date, location, registration number, odometer)
  • Data falsification, deletion or destruction
  • Incorrect use of switching device

Exceptional circumstances

EU Regulation 561/2006, Article 12

In exceptional circumstances, the driver may deviate from the rules in order to reach an establishment or place of residence to take the weekly rest period:

  • 1-hour extension — to reach an establishment or place of residence
  • 2-hour extension — a 30-minute break is mandatory beforehand
  • The extension must be compensated by an equivalent rest period

Report structure

The report analyses the driver's activity broken down by week. Weeks are numbered starting from the week beginning 3 January 2000 — the week number is shown in brackets in the header. This numbering ensures that compensations and overlapping rest periods can be unambiguously assigned to the correct week.

EU indicator

The truck icon labelled EU indicates that the driver's weekly rest is calculated according to the 4-week cycle (in the case of international transport).

For each infringement the report contains:

  • Period — start and end of the infringement (date, time)
  • Extent of excess — how much the permitted limit was exceeded
  • Vehicle details — registration number and odometer reading
  • Legal reference — EU regulation article and paragraph
  • Severity level — categorisation of the infringement
